Residence permit for Couples from Mercosur and Bordering Countries: How the Agreement Makes It Easier

Brazil has special agreements with Mercosur and South American countries that make the residence process for foreign nationals simpler and more accessible.

These agreements are especially advantageous for couples in which one partner is Brazilian and the other comes from a neighboring country.

What is the Mercosur Residence Agreement

The Mercosur Residence Agreement is a treaty signed between member and associated countries (such as Argentina, Uruguay, Paraguay, Bolivia, Chile, Peru, Colombia, and Ecuador).

It allows citizens of these countries to apply for a visa or residence permit in Brazil through a simplified process, with fewer documentation requirements and no need for a prior employment relationship.

Benefits for couples and families

When one partner is Brazilian, the foreign spouse or companion from a Mercosur country can apply either under the Mercosur Agreement or as a family reunification case.
The main advantage is the simplified process, shorter timelines, and fewer migration requirements.
Applicants can submit documents issued in their home country, as long as they are properly apostilled (or legalized at the Brazilian consulate if the country is not part of the Hague Apostille Convention).

Required documents

The main documents usually include:

  • Valid ID (passport or national ID card);
  • Birth or marriage certificate;
  • Proof of nationality from a Mercosur member or associated country;
  • Criminal background certificate;
  • Proof of address;

Bonus! Foreign documents are exempt from sworn translations.

In some cases, couples can also register a stable union to qualify for family-based residency.

Duration and renewal

The initial residence permit is valid for two years, after which it can be converted into permanent residency if the applicant continues living in Brazil and remains in good standing.
